Fourth Division Award No. 2859 (Weston) (RYA/Baltimore & Ohio RR)

"...If neither unassigned or substitute Yardmasters are available, then a regularly assigned Yardmaster must be used. When necessary to use a regularly assigned Yardmaster the senior qualified available regularly assigned Yardmaster who has signified in writing of his desire to be called for such service will be used..."

Fourth Division Award No. 2376 (Dorsey) (RYA/Lehigh Valley RR)

"Extra yardmasters (or other classes of employes used to perform extra yardmaster service) will not be considered 'available' unless they have had not less than eight (8) hours off duty from last period of service in any class or grade or position. (Emphasis supplied)

Fourth Division Award No. 3089 (Friedman) (RYA/Union Belt of Detroit RR)

"Carrier relies on Rule 4-G of the Agreement, which provides how 'regularly' assigned yardmasters used in other service' are to be paid. But Rule 4-G does not authorize Carrier to require them to cross craft lines and to give up their regular assignments."

Fourth Division Award No. 2969 (O'Brien) (RYA/Seaboard Coast Line RR Co.)

"Carrier cannot with impunity ignore a yardmaster's regular time for reporting for duty and require him to cover another assignment thereby precluding him from working his regularly bulletined position."

Fourth Division Award No. 2597 (Weston) (RYA/Chicago, Milwaukee, St. Paul & Pacific RR)

"In any event, it is clear that it was improper for Carrier to use Evans and Ferguson in this situation. There is no evidence that these employes were called upon to fill the disputed vacancies because of any real emergency."

Fourth Division Award No. 2541 (Bailer) (RYA/Atchison, Topeka & Santa Fe Rwy)

"When an employe is assigned a tour of duty with hours which overlap the hours of another assignment we do not think he properly may be considered available for the second assignment by the device of relieving him early from the first assignment so that he may be used on the second assignment to the deprivation of another fully available and qualified employe."

Fourth Division Award No. 3229 (Lieberman) (RYA/Grand Trunk Western RR)

"When an employe abandons his regular assignment, with Carrier's acquiescence, or quits early with Carrier's approval, is immaterial; both situations clearly fall within the language cited above in that the employe has left his assignment before its assigned hours have run their course."
